How to Practice Real Estate Law

What education, teaching, experience or skill development would you recommend to someone who wants to enter your area of practice? So what did I learn? First of all, the right one. Obviously, there is no confusion in my own firm as to which lawyer gets credit for a client who hires the firm. I understood how a law firm works and learned how to run a business, as a law firm owner and real estate developer. I am not an asset, a source of income or expenses within a larger organization of income and expenses. Instead, I see all the income and expenses and what makes them go up and down and whether or not the expenses generate more income. Having my own business has given me more flexibility in my children`s activities and has played a more emotional role in their lives, being more than just a salesperson. And I`m thrilled to have started the process of learning to be a real estate developer. Having my own business gave me the flexibility to learn the development business and refine areas I already knew, such as real estate financing. This meant spending time taking courses on building construction, learning to read a bunch of architectural plans, outsourcing my work to contractors, driving to my property whenever I wanted, and more. In addition to property issues, real estate attorneys must also work with restrictions that control what landlords are allowed to do with their property. A major restriction on the use of real estate is zoning. Within broad categories of residential, commercial and industrial zoning, there are often subcategories with detailed requirements and restrictions. Most zoning takes place at the local level, so real estate attorneys must work with local government and zoning authorities to challenge restrictions and promote clients` interests.

While other areas of activity are more fluid and offer many routes out of legal practice, this area of activity is somewhat limited. Some real estate lawyers will transition over the course of their career from practicing law in a large law firm to an in-house position at a bank, insurance company, national retailer or other institutional real estate company. Beyond the internal pathway, however, there is no natural progression from this area of practice to other common career paths. Whether you are new to real estate law or are already settled in the area, you will benefit from the expert advice and advice in this book, drawn from years of practice by an experienced real estate lawyer. Construction documents are often drafted and negotiated by lawyers who specialize in these areas, but real estate lawyers often have to review and/or negotiate them in the context of development – from financing to joint ventures to land use issues and more, real estate lawyers deal with a myriad of areas. which makes the practice both challenging and exciting. For many, working in real estate law is exciting because they can see their efforts directly as they walk around their neighborhood. But what is it really like to work as a real estate lawyer, and what can you do to prepare yourself if that`s a path you`re considering? The answer was clear. I would start my own real estate law firm in a smaller market and become a real estate developer at the same time. Forward! Well, at least I would develop a property to start with. Thus, The Lazovitz Firm was born just outside Philadelphia, in the city of Conshohocken (pronounced kon-shi-HOCK-in, an Unami word of the Lenape people).

Thanks to the law firm, I was able to bring my many years of experience in the practice of law. 10. If you were to recommend a candidate to a room crowded with law graduates, what specific qualities would they have to ensure success in this field? This industry is strongly influenced by general business cycles and economic trends. When the economy is growing and interest rates are low, the real estate market tends to thrive and there are a variety of real estate purchases and refinancings. The emergence of commercial mortgage-backed securities financing for real estate projects has also contributed to the growth of the real estate market. However, during a recession, many retailers are reluctant to open new stores or expand their presence, and lenders are reluctant to make new home loans. These trends affect the pool of real estate transactions. The qualities needed to ensure success in this area include attention to detail, the ability to anticipate problems, and the ability to help clients navigate and complete a transaction. The ability to juggle competing requirements is also important, as many lawyers need to work on multiple projects at the same time and effectively prioritize their daily workload so they don`t miss critical deadlines. 6. Among the people in this practice group who hate it, what exactly do they hate about it? When lenders make these loans, they have all sorts of concerns that lawyers address. Lenders take their money and give it to someone else – it`s always a little scary.

They want to know that they will be reimbursed, what their security is (i.e. what is their security) if they are not repaid, how to enforce the remedies against the borrower if they are not repaid. and a list of at least 100 other concerns that lenders want to secure before handing over the money. With my experience, I also represent commercial real estate lenders. Not everyone who owns a property owns the property. Leasing is another important topic in real estate law. Whether a tenant is a residential or commercial tenant, the terms of a lease are crucial for both the landlord and the tenant. Real estate lawyers help their clients draft, negotiate and understand leases. The parties to a real estate lease can negotiate the lease or use litigation to resolve their disputes. Due diligence investigations are also a big part of a real estate lawyer`s job. These due diligence investigations may include: examination of the physical details of the property and may include an environmental investigation (to ensure there is no contamination), examination of tenants` leases in the property and examination of title to ensure that the seller actually owns the property and that there are no easements, mortgages or other liens on the property, including tax privileges.

Having my own law firm instead of working for a larger institution would also allow me to do what my clients have been doing for years – investing and developing commercial real estate. It`s not so easy when you`re working for a company where doing something entrepreneurial “on the side” when billable hourly requirements need to be met isn`t exactly considered compatible with the company`s mission statement. It was a good time in my life to be a real estate developer too, so I took the plunge. I bought a building in downtown Philadelphia and am in the process of converting it from a single-family home into three apartments that I plan to rent this summer. And I can`t wait to do another one. Most real estate transactions have a quiet beginning and end. Therefore, lawyers in this area are pleased with the fact that transactions rarely linger and are concluded over a period of months rather than years. In addition, every real estate transaction has its own problems. Dealing with these issues with clients presents their own challenges, but provides intellectual stimulation. Once you`ve opened your real estate practice, you`ll want to expand your client list.

We have three proven tips to get you started: Real estate lawyers need to know the state law that applies to their case. State laws are the main laws that apply to real estate.
